New article – Full Federal Court in COT v Lane – bankrupt trading trustees and statutory priorities, the principle of ‘hotchpot’, and the treatment of preference recoveries of payments of trust money

I have added a new article to my website reviewing an important decision of the Full Federal Court handed down in November 2020, addressing 3 key questions that arose at the intersection of trust law and bankruptcy law – Commissioner of Taxation v Lane [2020] FCAFC 184 (COT v Lane). Some were similar to those which arise in the context of corporate insolvency law, and were addressed in recent years by the High Court in Carter Holt/Amerind and the Full Federal Court in Jones/Killarnee.
