The High Court, by a 3:2 majority, has dismissed the Commissioner’s appeals from the Full Court of the Federal Court of Australia, in Commissioner of Taxation v Australian Building Systems PL (in liq) [2015] HCA 48. Four separate judgments were written: by French CJ and Kiefel J and by Gageler J in the majority; Keane J and Gordon J each wrote separate judgments in dissent.
